Personal injury legal costs in Australia are heavily regulated. The 25% uplift cap on conditional costs agreements (Legal Profession Uniform Law s182) limits what firms can charge as a premium. The disbursements are what move.

Under Legal Profession Uniform Law s182(2), the uplift in a conditional costs agreement cannot exceed 25% of the firm’s professional costs — not 25% of the settlement. If the firm’s professional fees for two years of work are $80,000 and you settle for $400,000, the maximum uplift is $20,000 (25% of $80,000), not $100,000.
