What does a will cost in Australia?

A simple will is typically A$300–A$700 when drafted by a lawyer. More complex wills (blended families, business interests, trusts, overseas assets) range A$700–A$2,500+. Power of attorney and advance care directives are usually A$200–A$500 each. Online will kits are cheaper but they fail more often than they save.

What is probate and do I need a lawyer?

Probate is the legal process of recognising a will and authorising the executor to manage the estate. You can apply for probate yourself in straightforward matters, but most executors hire a lawyer because the process is technical and the consequences of getting it wrong fall on them personally. Cost typically A$1,500–A$5,000 plus court filing fees.

Can a will be challenged?

Yes. In every Australian state, family members (and sometimes dependants) can apply for a larger share than the will provides — this is called a family provision claim. Strict time limits apply (usually 6–12 months from grant of probate). If you've been left out of a will, speak to a lawyer urgently.

What happens if I die without a will?

You're "intestate". Your estate is distributed according to state intestacy laws — usually to your spouse and children in fixed proportions. Same-sex partners, step-children, and de facto partners may receive less than you'd expect (or nothing). Making a will is the simplest fix.
